27-year-old British tourist arrested after female tourist ‘was sexually assaulted’ at hotel near Marbella

A British tourist has been arrested on suspicion of sexually assaulting a compatriot in a hotel on the Costa del Sol.

The 27-year-old man was arrested after the tourist said she had been the victim of a sexual attack at the unnamed “luxury” hotel in Puerto Banus, near Marbella.

She alleged it had occurred during an impromptu party with friends organized after they met at a nearby beach club.

The woman, aged about 26, was taken to hospital to be examined by a specialist doctor.

The suspect was arrested shortly after.

Police have yet to make any official comment and it was not immediately clear this morning whether the Briton has yet appeared in court and whether he is being held in custody or on bail pending an ongoing investigation.

A National Police spokesperson in Malaga said today: “We can confirm that a 27-year-old British man has been arrested on suspicion of sexually assaulting a woman.”

Earlier this month, an RAF soldier was arrested in Mallorca after a British tourist accused him of raping her at a four-star hotel in Magaluf.

He was released and allowed to fly back to the UK, but was told he remained under investigation after his accuser failed to uphold her police complaint to a judge.

In February, a British tourist was sentenced to four years in prison in a Palma court after confessing to raping his son’s friend in a Magaluf hotel room.

Spanish prosecutors said before David McPaul Wigging’s Feb. 5 trial that they wanted him jailed for nine years if convicted of the May 9, 2023, sexual attack.

The 43-year-old also reached a plea deal through his lawyer before the full trial.

It was confirmed that he would receive a four-year prison sentence during a brief public hearing later, although he will only serve two years behind bars.

The fact that he was very drunk when he attacked his victim, who is also from the UK and believed to be in his twenties, was taken into account as a mitigating factor.

He will be expelled from Spain on May 8 of next year once he has served half of his sentence. To determine the two-year limit, the time already spent behind bars in preventive detention has been taken into account.

Wigging’s defense attorney, Fernando Mateas, said at the time that the plea deal he had helped negotiate for his client meant he would be a free man after May 8, 2025.
